1. General Terms & Acceptance

These Terms & Conditions (the "Terms") constitute a legally binding agreement between KASEO ("KASEO," "we," "us," or "our"), a sole trader operating under the trading name KASEO and based in Malta, and any individual accessing or using this website or placing an order (the "Customer," "you," or "your"). By accessing this website or submitting an order, the Customer confirms that they are at least 18 years of age, or are acting under the supervision of a parent or legal guardian, and agrees to be bound by these Terms in their entirety. Partial acceptance of these Terms is not permitted.

These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, form the entire agreement between KASEO and the Customer in relation to their use of this website and any purchase made through it, and supersede any prior agreement, representation, or understanding, whether oral or written.

KASEO reserves the right to amend, update, or replace these Terms at its sole discretion and at any time. Any such amendment shall take effect upon publication on this website. It is the Customer's responsibility to review these Terms periodically; continued use of the website following any amendment constitutes acceptance of the revised Terms.

2. Orders, Pricing & Payment

All orders placed through this website constitute an offer by the Customer to purchase the relevant product(s), which KASEO may accept or decline at its sole discretion. A binding contract of sale is formed only upon KASEO's confirmation of the order by email. KASEO reserves the right to refuse or cancel any order, including where a product is listed at an incorrect price as a result of a technical or human error, where fraudulent or suspicious activity is suspected, or where KASEO reasonably believes the order was not placed in good faith. Where an order is refused or cancelled under this clause, any payment already received shall be refunded in full.

All prices are displayed in Euro (€) and are inclusive of applicable VAT unless otherwise stated. Delivery charges are calculated separately and disclosed in full prior to completion of purchase. KASEO reserves the right to amend prices at any time; such amendments shall not affect orders already confirmed.

Payment is processed securely at the point of order through KASEO's third-party payment providers. KASEO does not store the Customer's full payment card details. Title to the products ordered shall not pass to the Customer until payment has been received in full.

As each KASEO product is manufactured to order, no inventory is held in stock, and production commences promptly following order confirmation. Full details of production and delivery timelines are set out in our Shipping Policy.

3. Delivery & Customs

Estimated production and delivery timeframes are provided at checkout and in our Shipping Policy for guidance only and do not constitute a guaranteed delivery date. KASEO shall not be liable for any delay in delivery caused by circumstances beyond its reasonable control, including but not limited to customs processing, carrier delays, or events of force majeure.

KASEO ships internationally. Where an order is shipped outside the European Union, the Customer shall be solely responsible for any customs duties, import taxes, VAT, or other charges levied by the destination country's customs authority. Such charges are not included in the price displayed at checkout, and KASEO accepts no liability for delays or additional costs arising from customs processing.

Risk in the products shall pass to the Customer upon delivery to the address provided at the time of order. It is the Customer's responsibility to ensure that the delivery address supplied is complete and accurate; see our Incorrect Address Policy where a correction is required after dispatch. Where an order fails to arrive within the estimated delivery window, the process set out in our Lost Parcel Policy shall apply.

4. Cancellation Rights, Returns & Refunds

Customers located in the European Union or the United Kingdom benefit from a statutory right to cancel their order within fourteen (14) calendar days of delivery, without providing a reason. To exercise this right, the Customer must contact KASEO at contact@shopkaseo.com, or submit the withdrawal form provided on this website, prior to returning any item. Goods must then be returned to KASEO, unused and in the condition in which they were received, within fourteen (14) calendar days of notifying KASEO of the cancellation. Return shipping costs are the Customer's responsibility, save where the item is faulty, incorrect, or damaged. Full instructions, including the applicable return address, are set out in our Refund Policy.

Where an item arrives damaged, defective, or otherwise not as ordered, the Customer is not required to return the item. Instead, the Customer must contact KASEO with details of the issue, which may include photographic and/or video evidence, in accordance with our Damaged Items Policy. Claims submitted without the evidence reasonably requested by KASEO may not be processed.

As every KASEO product is manufactured to order, refunds for reasons other than the above — including simple change of mind outside the EU/UK cancellation window described above — are offered solely at KASEO's discretion, save where required by applicable law. Gift cards are non-refundable.

Nothing in this clause affects the Customer's statutory rights, including the two-year legal guarantee of conformity applicable within the European Union. Full terms governing returns, refunds, and exceptions are set out in our Refund Policy, which forms part of these Terms by reference.

5. Warranty & Product Safety

KASEO products are manufactured to a high standard and are covered by the statutory guarantee of conformity applicable under EU and Maltese law. In addition, KASEO offers a commercial warranty covering manufacturing defects, as further described in our Warranty Policy. This commercial warranty does not cover damage arising from misuse, negligence, normal wear and tear, or failure to follow reasonable care instructions. Where a valid warranty claim is accepted, KASEO's primary remedy is repair or replacement; a refund shall be provided only where repair or replacement is not possible. This commercial warranty is in addition to, and does not affect, the Customer's statutory rights.

KASEO products comply with the applicable EU product safety framework, including Regulation (EU) 2023/988 on General Product Safety. KASEO maintains a designated Responsible Person for the purposes of EU market compliance; further details are available on request or, where applicable, on the relevant product listing. Should any safety concern arise in relation to a KASEO product, including as part of a product recall, KASEO will notify affected Customers where reasonably possible and offer a choice of repair, replacement, or refund as appropriate. 6. Website Use, Accounts & Reviews

The Customer agrees to use this website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, any third party. Without limitation, the Customer shall not: use this website to transmit unlawful, threatening, abusive, or defamatory content; interfere with the proper operation of this website, including through the introduction of viruses, malware, or other harmful code; attempt to gain unauthorised access to this website, its servers, or any connected system; or use any automated means to extract data from this website without KASEO's prior written consent. KASEO reserves the right to suspend or terminate access to this website for any Customer in breach of this clause, and the Customer shall be liable for any loss or damage arising from such breach.

Where the Customer creates an account on this website, they are responsible for maintaining the confidentiality of their account credentials and for all activity conducted through their account. KASEO reserves the right to suspend or close any account where suspicious, fraudulent, or unlawful activity is reasonably suspected.

Where the Customer submits a product review or other feedback, KASEO shall be entitled, but not obliged, to publish and reproduce such content on this website and in its marketing materials, for so long as the relevant product remains available for sale. KASEO is not responsible for the content of Customer reviews but will act on notices of unlawful content in accordance with applicable law and our Privacy Policy. A Customer may request removal of their submitted review at any time by contacting contact@shopkaseo.com.

7. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, product designs, images, and the KASEO name and branding, is the property of KASEO or its licensors and is protected under applicable copyright, trademark, and other intellectual property laws. Nothing in these Terms grants the Customer any right, title, or interest in such content, save for a limited, non-exclusive licence to view and use this website for personal, non-commercial purposes in connection with placing an order.

The Customer shall not reproduce, copy, modify, distribute, publish, or otherwise exploit any content from this website for any commercial purpose without KASEO's prior written consent. Any unauthorised use of KASEO's intellectual property may result in legal action and a claim for damages.

8. Limitation of Liability

To the fullest extent permitted by applicable law, KASEO shall not be liable for any indirect, incidental, or consequential loss or damage arising from the Customer's use of this website or purchase of KASEO products, including but not limited to loss of profit, loss of data, or loss of opportunity, even where KASEO has been advised of the possibility of such loss.

KASEO shall not be liable for any damage, injury, or loss arising from the Customer's misuse of a product, failure to follow reasonable care or usage instructions, or use of a product for a purpose for which it was not intended. The Customer is responsible for inspecting products upon delivery and reporting any issue in accordance with the relevant policy referenced in these Terms.

Save where required otherwise by applicable law, KASEO's total liability to the Customer in respect of any single order, however arising, shall not exceed the total price paid by the Customer for that order.

Nothing in these Terms shall exclude or limit KASEO's liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded or limited under applicable law, including the Customer's statutory rights as a consumer.

9. Changes to These Terms & General Provisions

KASEO reserves the right to amend, update, or replace these Terms at any time, with such changes taking effect immediately upon publication on this website, as set out in Section 1. The version of these Terms in effect at the time an order is placed shall govern that order.

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect. KASEO's failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or of any other provision.

These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, Warranty Policy, Damaged Items Policy, Lost Parcel Policy, and Incorrect Address Policy, constitute the entire agreement between KASEO and the Customer in relation to their use of this website and any purchase made through it.

10. Governing Law, Disputes & Contact

These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of Malta, without regard to its conflict of law provisions. This shall not deprive Customers who are consumers of the protection afforded by any mandatory provisions of the law of their country of habitual residence, where such protection is more favourable to them.

Any dispute arising from these Terms or from an order placed with KASEO should, in the first instance, be raised directly with KASEO at contact@shopkaseo.com, with a view to reaching an amicable resolution within fourteen (14) calendar days. Where a resolution cannot be reached, EU consumers may refer the matter to the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr, or to the competent courts of Malta. Nothing in this clause prevents a Customer from bringing proceedings in the courts of their own country of residence, where applicable law entitles them to do so.
